  • Minimum 2 members & 2 Directors.

  • The company name ends with ‘Private Limited.’

  • No restriction on maximum number of members
  • The Company name ends with ‘Public Limited’.
  1. Non Profit Organizations:
  • It is for the purpose of promoting commerce, art, science, and not with making profit.
  •  It requires permission from Central Government.
  1. Minimum Capital of the Company:
  • Private Companies should have Minimum Capital of Rs.1 Lakhs for Registration.
  • Public Companies should have Minimum Capital of Rs. 5 Lakhs for Registration.
  1. Digital Signature:

Digital Signature is a legally recognized method of signing documents electronically. A digital signature is a type of asymmetric cryptography used to simulate the security properties of a handwritten signature on paper. Digital Signature schemes normally give two algorithms, one for signing which involves the users secret or private key and one for verifying signatures which involves the users public Key. The output of the signature process is called “Digital Signature”.

  1. Directors Identification Number (DIN):

Directors Identification Number or DIN is an identification number issued by the Ministry of Corporate Affairs to a director or a prospective director of a company. For obtaining a DIN, an online application has to be made to the Ministry of Corporate Affairs and the documents supporting Identity/Address Proof has to be submitted to their office.On verification of the documents, MCA will not allot the DIN.

What are the safeguards to be taken by the proprietor of a registered trade mark to protect his rights?

The proprietor should use and renew the trademark regularly and in time. If others misuse the trademark he should file a suit for infringement and passing off and also take criminal action.

The proprietor should keep a watch in respect of trademarks published in the Trade Marks Journal and institute opposition proceedings if identical or deceptively similar trademarks are advertised. He should initiate rectification proceedings if an identical or deceptively similar trademark is registered.

Can I register my domain name as a trademark or service mark?

Yes, so long as it is being used as a trademark or service mark. If it is merely used to indicate the URL or address at which a web site may be found, such use is not sufficient. It must be used as a source identifier for the goods or services.

Opposition on Applied Trademark Registration?

Within a period of three months from the date of advertisement in the Indian Trademark Journal, any party may lodge opposition to the registration of the trade mark. Extensions of this period can be obtained on application to the Registrar

Various grounds of opposition are available and include conflict with prior registered or common law trade marks. Generally trade marks which do not conform with the requirements for registration may be opposed.

Opposition is an important facility, especially in that it affords trade mark owners the opportunity of ensuring that competitors do not register similar trade marks.

What are the term / Duration of the Trademark Registration in India?

How soon after I deposit my creation does it enjoy Copyright protection?

The consideration and protection on the document transmitted in secure mode, your copyright deposit, are instantaneous.

Indeed, the Act states that copyright, provided the original work or design, protection is afforded at creation. Thus, your creation, implementation, design, web site, written or published on the Web, your music, your project, are already holders of copyright. It is enough to prove priority with a copyright deposit. Deposit gives a certain date (priority of copyright) for your deposit creation. Your deposit is uncontestable proof of copyright. The deposit is your official witness of your right to your creation or design.
How long does copyright protection last?

The protection by filing copyright is valid for life + 70 years after the death of the author. Copyright deposits are archived with officers, who are obliged by decree of State to retain all documents lodged with them in an integrated way, uncontestable (unalterable content of material submitted) and retrievable at any time by the holder of intellectual property rights relating to the copyright of the applicant.
